1. Legal information and acceptance

These provisions rule the use of the web page service (hereinafter referred to as the “Web”) that Scati Labs, S.A. (hereinafter referred to as SCATI) makes available to Internet users under the domain www.scati.com and its respective sub-domains and sub-directories, property of SCATI.  

SCATI is the owner of the Web, with registered office at Bari, 23, Parque Empresarial PLAZA, 50197 Zaragoza (Spain) and VAT number A-50768050, and registered in the Commercial Register of Zaragoza (Spain) Volume 2300, Sheet 76, Section 8, Page Z-23.154.

The use of this Web confers the status of User (hereinafter referred to as the “User”) and implies full acceptance of all the conditions of use contained in this Legal Notice.

SCATI, in compliance with what is established in Law 34/2002, of 11 July on Information Society and Electronic Commerce Services, makes this present Legal Notice available to users of this Web, who shall refrain from using it if not agreeing with its content. Access, browsing and use of this Web means an act of tacit acceptance by the User of these present terms and conditions.

The User must carefully read this present Legal Notice each time he/she intends to use this Web, as this Legal Notice and its conditions of use may be altered.

In this regard, SCATI reserves the right to modify this present Legal Notice at any time and to modify, delete or update the content in this Web and/or cancel, interrupt or stop operating at any time for security, technical, maintenance or any other kind of reasons without prior notice.

Certain services of this Web are exclusively for our customers and its access is restricted. Products or services of a general nature supplied by SCATI shall not be offered or provided, under no circumstances, through the service of the Web. Some services of the Web that are accessible and exclusive for SCATI customers may be subject to particular conditions, regulations and instructions that, as the case may be, replace, complete and/or modify this present Legal Notice and shall be accepted by the User before the provision of the corresponding service.   

2. Intellectual and industrial property

All contents in this web, which is hereby understood as including but not being limited to the following: texts, photographs, graphics, images, icons, technology, software, links and other contents, as well as the graphic design and source code (hereinafter referred to as the “Contents”), are the intellectual property of SCATI or of third parties (hereinafter referred to as the “Contents of Third Parties”) and it cannot be construed that any of the operating rights thereof have been assigned to the user beyond those that may be strictly necessary for correct operation of the Web.

Brands, trade names or distinctive signs are the property of SCATI or of third parties. Access to this Portal can in no way be understood as conferring any rights on the above-mentioned brands, trade names and/or distinctive signs.

SCATI is not responsible and neither does it guarantee the veracity, accuracy or reliability of any Content of Third Parties. SCATI shall not be held responsible for illegal or unauthorised use made by the User on the Content of Third Parties.

3. Conditions of use of the Web

General

The User undertakes to use the Web correctly in full accordance with the Law and with this present Legal Notice. The User shall respond to SCATI or to third parties for any damages that might be caused as a result of breach of these obligations.  

It is expressly forbidden to use the Web for injurious purposes to properties or interests of SCATI or of third parties or that in any other way may damage or disable the networks, servers and other computer equipment, products and/or software of SCATI or of third parties.

Contents

The User undertakes to use the Contents in accordance with the Law and with this present Legal Notice. Consequently, the User shall not, under no circumstances:

  • Reproduce or copy the Contents or Contents of Third Parties for commercial purposes.
  • Communicate or make available to third parties the Contents or Contents of Third Parties when these acts necessarily involve reproduction by the User or by a third party.
  • Reproduce, copy, distribute, make available, publicly communicate, transform or modify the Contents except in those cases that are expressly authorised by the law or expressly agreed in writing by SCATI or by a third party holding the ownership of the exploitation rights.

Links from this Web page

The User who wants to introduce links to the Web from their own web page will need prior and express consent in writing by SCATI.

The User may find links to other pages in this Web. Those links are not a suggestion, invitation or recommendation to visit those sites and therefore, SCATI shall not be held responsible for the accuracy or relevance of the information contained in those sites or for the result obtained through them.

The existence of links shall not imply the existence of relationships between SCATI and the owner of the linked web page, nor SCATI knows the contents and services of the linked sites. Consequently, SCATI shall not be held responsible for damages resulting from the unlawfulness, quality, outdating, unavailability, error or futility of their contents and/or services or for any other damage that is not directly attributable to SCATI, being the User responsible for the browsing and use of the web pages to which they are linked.

Data collection forms

Without prejudice to the provisions of our privacy policy, the use of certain services or applications sent to SCATI are conditioned upon completion of the related registration of the User.

The User shall be responsible for all information provided or communicated through the web forms for the above purposes or for any other purposes, the User being the sole responsible for false or inaccurate statements.

Exclusion of liability

  Access to the Web implies no duty on the part of SCATI to check the truthfulness, accuracy,  adequacy, suitability, exhaustiveness and timeliness of the information provided through it. The contents in this page are of a general and informative nature. The User accesses the Web under their sole responsibility.

SCATI shall not be held liable for decisions taken based on the information provided in the Web nor for damages to the User or to third parties arising from actions based on the information obtained from the Web,  for damages resulting from errors or omissions in the contents, errors in the computing system, lack of availability of the portal, damages to the computer equipment of the User or of third parties, transmission of viruses, malware or any other harmful computing element.

It is, in any case, the User’s responsibility to have the suitable tools to prevent and disinfect the system from harmful computer programs.

Likewise, SCATI shall not be held responsible for damages of any kind made to the User as a result of failures or disconnections in the telecommunications networks producing the suspension, cancellation or interruption of the Web service while in use or beforehand.

Personal data protection

Processing of personal data

SCATI considers as a basic objective to ensure the privacy and confidentiality of the personal data of Users collected through any system, which allows for the transmission of data and declares its commitment to comply with the regulations established in the General Regulation for Data Protection ((UE) Regulation 2016/679 of the European Parliament and Council, of 27 April 2016, on the protection of individuals with regards to the processing of personal data and the free movement of such data and repealing Regulation 95/46/CE), taking the security measures needed to ensure the confidentiality, integrity, availability and to avoid alteration, loss, processing or unauthorised access by third parties. Policy on the use of Cookies

In compliance with the provisions in Article 22.2 LSSI, SCATI shall use data storage and recovery devices (“Cookies”) only when the user has given their prior consent in accordance with what is indicated in the pop-up window of the user browser when first accessing the Portal and under the terms and conditions stated in SCATI Cookies Policy, which all users should know.
